Vaspitni nalozi – savremeni oblik reagovanja na maloletničku delinkvenciju
Educational orders – modern form of reaction to juvenile delinquency

U radu je prikazan trend primene vaspitnih naloga u Republici Srbiji, za period od 2012. do 2017. godine, sa osvrtom na probleme koji se pojavljuju u njihovoj realizaciji. Evidentan je blagi porast primene vaspitnih naloga, iako je njihova zastupljenost u poređenju sa ukupnim brojem krivičnih prijava i ukupno izrečenim krivičnim sankcijama i dalje minimalna. Tokom 2012. godine vaspitnim nalogom razrešeno je samo 3,22% slučajeva u kojima je podneta krivična prijava protiv maloletnika, dok je u 2017. vaspitnim nalogom razrešeno 11,49% slučajeva u kojima je podneta krivična prijava. Najzastupljeniji vaspitni nalog svih godina tokom posmatranog perioda bio je Poravnanje sa oštećenim, dok se vaspitni nalozi najčešće primenjuju za krivična dela protiv imovine, krivična dela protiv javnog reda i mira i u slučaju krivičnih dela protiv života i tela. U izvršenju vaspitnih naloga pojavljuju se brojni problemi, kao što su nepotpuna normativna regulativa, loša interresorka saradnja, nedostatak jed...nakih institucionalnih kapaciteta u lokalnim zajednicama i dr. Uvažavanjem i radom na neregulisanim pitanjima u ovoj oblasti, očekuje se da primena i realizacija instituta vaspitnih naloga bude na znatno višem nivou, uz ostvarivanje svih pozitivnih efekata koje njihova primena donosi
The paper presents the trend of application of educational orders in the Republic of Serbia for the period 2012-2017., with an overview of the problems that arise in their realization. There is a slight increase in the use of educational orders, although their representation is still minimal compared to the total number of criminal charges and total criminal sanctions. During 2012. only 3.22% of cases of criminal charges againts juvenile were resolved with the educational order, while in 2017. 11.49% of the cases of criminal charges againts juvenile were resolved with the educational order. The most frequent educational order for all years during the observed period was Alignment with the damaged, while educational orders are most often applied for criminal acts against property, criminal acts against public order and for criminal acts against life and body. Accepting the experience of people from practice, the most significant problems in the implementation of educational orders are i...ncomplete normative regulations, poor inter-departmental cooperation, lack of equal institutional capacities in local communities, еtc. By respecting and working on unregulated issues in this area, it is expected that the implementation and realization of the educational orders institute will be at a much higher level, while achieving all the positive effects that their application brings.
